Terms of service
These terms are the agreement between you and BattenProof when you create an account or buy anything from us. Please read them, particularly section 4 (what BattenProof is and isn't) and section 9 (liability).
1. Who we are
BattenProof is run by Kieron Evans, a sole trader, of 5 Lowerdale Drive, Pontyclun, CF72 8DY ("BattenProof", "we", "us"). Email: hello@battenproof.co.uk.
2. Who BattenProof is for
BattenProof is for businesses: sole traders, partnerships and companies working in construction. By using it, you confirm you're using it for your business and that you're 18 or over. If you sign up on behalf of a company, you confirm you have authority to agree to these terms for it.
3. What you get
BattenProof asks you questions about your business and uses your answers to produce health and safety documents in Word and PDF. Depending on what you buy, this includes:
- Single RAMS (£15): a risk assessment, method statement and site inspection checklist for one project.
- Starter set (£79, one-off): the company documents listed on our website, plus the SSIP evidence index.
- Compliance pass (£99 a year): everything in the starter set, unlimited project RAMS, regenerating your documents when things change, and the key dates tracker and reminders.
We're not registered for VAT, so no VAT is added to these prices. If that changes, we'll tell you before it affects anything you pay.
4. What BattenProof is and isn't
- The documents are yours to check and adopt. They're built from the answers you give and from wording written for common tasks. Before you use them, you must read them and make sure they match your business, your people and the work you actually do. Signing them makes them your policy and your arrangements.
- You stay responsible for health and safety. BattenProof helps you write things down. It doesn't manage your sites, supervise your work or replace your duties under health and safety law. Every RAMS must be checked against the actual site before work starts, and site-specific hazards added.
- We're not your competent person. The law requires you to have competent health and safety help, and SSIP schemes ask you to name a person. Software can't fill that role. Our list of independent advisers is for information only; we don't recommend or take payment from any of them.
- We're not an SSIP scheme. We don't issue certificates, and we can't guarantee that a scheme, client or main contractor will accept your documents. They make their own decisions.
- COSHH entries must be checked. You must check each substance against your supplier's current safety data sheet before using the COSHH assessment. BattenProof won't produce it until you confirm you have.
- The information must be accurate. The documents are only as good as your answers. Keep your profile up to date.
5. Your account
Keep your sign-in email secure. You're responsible for what happens in your account. Tell us straight away at hello@battenproof.co.uk if you think someone else has used it.
You can delete your account at any time from Account → Delete account. This permanently removes your profile, projects and documents. Download anything you want to keep first.
6. Payments, renewal and refunds
- Payments are taken by Stripe. You'll get a receipt by email.
- Single RAMS and starter set are one-off payments.
- The compliance pass lasts 12 months and renews automatically at the price shown at the time, unless you cancel. We'll email you at least 14 days before it renews, with the price and how to cancel. You can cancel at any time from your account or by emailing us; the pass then runs until the end of the year you've paid for and doesn't renew.
- Refunds: your documents are produced straight away. If something goes wrong and we can't fix it, we'll refund you. If you've paid but haven't generated anything, you can ask for a full refund within 14 days of paying. Once documents have been generated, we don't offer refunds for change of mind. If the pass renews and you email us within 14 days of the renewal date without having generated anything that year, we'll refund the renewal.
- We may change prices for the future. That won't affect anything you've already paid for, and we'll give you at least 30 days' notice before a pass renews at a new price.
7. Using the documents
- Once you've paid, you can use, edit, copy and print your documents for your own business, for as long as you like, including after your account ends.
- You can share them with clients, main contractors, assessors and your own advisers.
- You may not sell, publish or give away BattenProof's documents, templates or task library as a product or template pack, or use them to provide a document service to other businesses.
- The software, the website, our templates and our task and hazard wording belong to us. Everything you enter about your business stays yours.
8. Fair use
Don't misuse BattenProof: no attempts to access other people's accounts, overload or copy the service, scrape the templates, or use it for anything unlawful. We may suspend or close an account that breaks these terms. If we do, we'll tell you why and, where it's fair, refund any unused part of a pass.
9. Our liability to you
- We'll provide the service with reasonable care and skill. If something we produce is wrong because of a fault in BattenProof, tell us and we'll fix it or refund what you paid for it.
- Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
- Otherwise, our total liability to you under or in connection with these terms is limited to the amount you paid us in the 12 months before the claim.
- We're not liable for loss of profit, loss of contracts or tenders, failed or delayed accreditation, or any indirect or consequential loss.
- We're not liable for loss caused by information you gave us being wrong or out of date, by documents not being checked, adapted or followed on site, or by work carried out in a way the documents don't describe.
10. The service
We aim to keep BattenProof available and your information safe, but we can't promise it will never be interrupted. We may update or change features. If we make a change that significantly reduces what a paid pass includes, you can cancel and get a refund for the unused part.
If we ever close BattenProof, we'll give you at least 60 days' notice so you can download your documents and data, and refund any unused part of a pass.
11. Looking after information you enter about others
When you enter information about your staff, subcontractors or other people, you are the controller of it and we process it for you. We will:
- use it only to provide BattenProof to you, following your instructions as set by how you use the service;
- keep it confidential and make sure anyone working on BattenProof is bound to do the same;
- keep it secure, stored in the UK except for the services listed in our Privacy notice, and tell you if we change those services;
- help you respond to requests from people exercising their data rights;
- tell you without undue delay if we become aware of a breach affecting it;
- delete it when you delete your account (from backups within 90 days);
- give you the information you reasonably need to show we're meeting these commitments.
You confirm you have a lawful basis to give us this information, and that you'll only enter what your documents need.
12. Changes to these terms
We may update these terms. We'll email you at least 30 days before a change that affects you takes effect. If you don't agree, you can cancel before then and get a refund for any unused part of a pass.
13. General
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce a right straight away, we can still enforce it later.
- These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute.
